A Beginner’s Guide to Conveyancing and the Scottish Property Market

Navigating the Scottish property market can be a daunting task, especially if you’re new to the process. Whether you’re buying or selling property in Scotland, understanding conveyancing is crucial.

At Oracle Law, we ensure that your transactions are smooth, transparent, and hassle-free.

Below is our beginner’s guide to conveyancing to help you get started!

What is Conveyancing?

Conveyancing is the legal process of transferring property ownership from one party to another. It involves several steps, including preparing legal documents, conducting searches, and ensuring that both the buyer and the seller meet their contractual obligations.

The Conveyancing Process

Initial Preparations

Engage a Solicitor: The first step in any conveyancing process is to hire a qualified solicitor. At Oracle Law, we have a team of experienced conveyancers who understand the nuances of Scottish property law.

Property Valuation and Survey: For buyers, it’s essential to get the property valued and inspected to identify any potential issues.

Agreement in Principle: Before making an offer, secure an agreement in principle from a mortgage lender if you’re financing your purchase with a loan.

Making and Accepting an Offer

Formal Offer: Once you’re ready, your solicitor will draft a formal offer to purchase the property.

Missives: In Scotland, the exchange of offers and acceptances, known as missives, forms the binding contract between parties.

Legal Checks and Searches

Title Search: This step ensures that the seller holds the legal title to the property and can transfer it to you.

Property Enquiries: Your solicitor will conduct various searches, including local authority searches and environmental checks, to uncover any issues that may affect the property.

Signing the Contract

Once all checks are complete and both parties are satisfied, the contract will be drafted and signed. In Scotland, this contract is legally binding.

Completion

Settlement: On the agreed completion date, the balance of the purchase price is paid, and the property officially changes hands. Your solicitor will handle the transfer of funds and necessary documentation.

Registration: Finally, your solicitor will register your ownership with the Land Register of Scotland.
