When an interdict can protect you
Protection from threatening, abusive or violent behaviour, with powers of arrest so a breach brings an immediate police response.
Trespass, encroachment, unauthorised works or interference with access – stopped while the underlying dispute is resolved.
Breached restrictive covenants, misuse of confidential information, passing off – stopped before the damage becomes irreversible.
Served with an interdict you believe is unjustified? It can be recalled or restricted. Take advice quickly.
An interdict is the Scottish equivalent of an injunction – a court order prohibiting specific conduct. Breach of an interdict is contempt of court, and where a power of arrest is attached, the police can act immediately. It is one of the most powerful protective tools in Scottish law.
In urgent situations the court can grant an interim interdict – often within days, sometimes without the other party being present. That speed is the point: protection first, full argument later.
For genuinely urgent cases, an interim interdict can be sought within days of instruction – occasionally within 24 to 48 hours where the risk justifies it. If you are in immediate danger, call 999 first. Then call us and we will move quickly.
